3. Your Content
We use "Operational Content" to mean everything you or your Organization upload or generate in the Service: assets, inventory quantities, locations, movements, shipments, orders, business contacts, photos, documents, custom fields, and related notes.
Your Operational Content is yours. Neither Ubiqo nor anyone else acquires ownership of it just because you upload it to the Service. Your Organization keeps every right it had before.
Limited license to Ubiqo
To provide the Service we need technical permission to process that content. You therefore grant us a worldwide, non-exclusive, royalty-free, limited license to host, store, copy, transmit, display, and process the Operational Content for the sole purpose of operating, maintaining, backing up, and improving the Service for you and your Organization, and of complying with applicable law. This license ends when the content is deleted from the Service, except for backup copies that are overwritten on normal cycles.
To be explicit: we do not sell personal data, we do not show advertising, and we do not use our customers' content to train artificial intelligence models.
Responsibility for what is uploaded
Your Organization is responsible for the Operational Content it uploads and for holding the rights and authorizations needed to do so. This includes, among others:
- Photos and documents that your Organization has sufficient rights to use.
- Third-party data, such as business contacts, suppliers, or customers, whose upload and processing must have an appropriate legal basis under the data protection laws applicable in your country.
- Information that does not infringe intellectual property rights, confidentiality obligations, or applicable law.
For Operational Content, your Organization decides what is uploaded, for what purpose, and who has access. In data protection terms, the Organization therefore acts as the data controller ("responsable") and Ubiqo as the processor ("encargado") that handles that information on the Organization's behalf and under its instructions.
